If they could see how safe and fun a well built one could be, they wouldn't be so harsh. I say impose the penalties if they are used in a destructive or unsafe manner, if some idiot is launching them in town and ruining things, then haul 'em off to jail.

Who would ban spud guns If you rob a bank are you going to do it with a spud gun. If you decide to kill some one are you going to use a spud gun.

Just like some ppl think that minors have fragile little minds that can seriosly be harmed by playing m-rated video games, now everyone is required to show ID when they buy a game, even a 70 year old dude. the thing about banning things is that it cause ppl to esclate or ignore the law flat out. Can't buy a game cause im 16, f*ck that ill make a fake ID (which is very nice to have might i add). Ban spudguns, we'll make them anyway. Ban making fireworks and explosives, well make them anyway.
The only way to prevent ppl from using spudguns is to ban all the parts to make one (no more pvc, glue, pipe, valves, bbq lighters....) which ain't gonna happen.
Politicians always think that there is only one way to fix a problem, which is almost never the case.
