Hmm... so how far can one take the Attractive nuisance doctrine do you think? For instance, if someone cuts their wrist smashing a car window that they're breaking in to and bleeds out, can they sue? I see it includes trampolines as an example. If a drunk teenage wandered on their property and bounced on their unfenced trampoline, fell and broke his neck...lawsuit?
I'm glad we don't have things like this in NZ, not that I've heard about anyway. People need to take responsibility for their actions. Obviously, the original intention of the law, about children and trespassing, is fair enough to a degree. I'm sure you'd be held liable here if a child drowned in your unfenced swimming pool.

Here the fence must be huge at a pool. Liability laws is why diving boards are a thing of the past here. Back yard in ground pools are fading here. Same here in Az...5' high. Until recently, I had a 1 acre, 10' deep Bass Pond (unfenced) in my front lawn. It is legal here because there are no regulations regarding Bass Ponds. However, my pool, which is miniscule by comparison must be fenced because pools are considered to be an "attractive nuisance". Go figure??? "Castle Doctrine" is becoming the law in more state these days. I'm sure it varies from state to state, but Arizona allows the use of lethal force to defend life OR property. That applies not just on your own property, but anywhere within the state.
