In all of australia spudguns are illegal. But if you are found to posses one it will just be taken off you. If you build another you might get a fine but if they find one with a silencer on it you will be put in jail or a HUGE FINE!

A silencer is something that silences a firearm and a potato gun isn't a firearm so it isn't illegal and you could just say its for looks if you get questioned.

Well spudguns can be classified as weapons depending on there use (purely rec.) if a cop where to see a potato gun with a silencer i think that he would most likely confiscate it....(god I can't spell)

That assessment shouldn’t be made out of certainty as the ATF classifies 'spud launchers', not as a firearm. Who knows though, they could nail you for trying to conceal your illegal activities. For example for the use of, accidental result, or intent to damage, or destroy property.

are excuse me aren’t spud guns illegal? ~experament_u2

Excuse me, what in the hell did you just say?! If your possibly questioning the legality of spud guns, Id have to say that pertains to there use, and the particular regions laws.

A silencer is most commonly a mechanism used to reduce sound emitted from a reaction. That doesn’t particularly define it to be fitted on a firearm. For instance, a muffler fitted to car exhaust. Surely, cutting noise emission by more then 2dB's.

Wow, thanks for your totally useless contribution.

Wow, thanks again!

Quite simply, don’t use your spud gun in a illegal manner, and I gaurn-damn-tee you that you wont have to worry about if the sound suppressing mechanism attach upon your spud gun barrel is 'illegal'. Problem solved!

In the first post of mine you mentioned, I was trying to say that it will be an illegal weapon if you attach a silencer of any sorts. On the 2nd post of mine that you mentioned, I was telling him his post doesen't belong here.

Its not illegal to build and own a silencer for a spud gun. But after the barrel size gets down to I think 3/4 inch diameter or less the sillencer does become illegal because ATF believs it can be modified to silence a real firearm, which it can. Thats why you need a class 3 firearms dealership liceanse or a perment to own a silencer for a paintball gun (and of course for a real firearm).

I think even though combustion are illegal here, most cops would either not care and just confiscate them and the other cops wouldn't know the legality of them and ask you to go home or not to fire them in a public place. I doubt any cop would enforce the full $4000(NZD) fine unless you fired at someone/animal or at private property and you would go to court and stuff and do community service as well as a fine or 3months in jail.

I would tell the cop about it and show him what it can do. Ask him if he wants to try, maybe youll make a new friend and get him on your side.
I read somewhere taht a potato gun should have a barrel biger than .50"
I think it was an ATF thing.

Edit: Nevermind that was what they said as the defintion of a firearm.
